AI Content Labeling Rules 2026: The Checklist for Creators and Agents
Short answer: since August 2, 2026 AI-generated and AI-edited images, audio and video that reach EU users must carry a machine-readable mark and be disclosed, and realistic depictions of people must be visibly labeled (EU AI Act, Article 50). Real-estate listings in California have needed a "virtually staged" label on every altered photo since January 1, 2026 (AB 723). Instagram, TikTok and YouTube add their own labels. None of this stops you from publishing — it changes the last two minutes of your workflow. This is not legal advice; it is the practical checklist we follow.

Machine-readable marks: keep what the models give you
Every Gemini image (Nano Banana 2 / Pro) and every Veo clip carries an invisible SynthID watermark; OpenAI (GPT Image 2.5) and Adobe attach C2PA content credentials. - Bio states that the persona is AI-generated (one plain sentence).
- Every post carries the platform's AI label; on Instagram keep C2PA so detection works.
- Never claim the model is a real person, real location or real event.
- Keep the original model outputs with their SynthID / C2PA marks; archive per post.
- Sponsored posts: disclose both the sponsorship and the AI origin.
- Watch for the account-level Instagram notice — it is triggered by repeated AI posts, not a penalty.

Checklist — virtual staging and altered listing photos
- Burn a small, legible label ("Virtually staged" / "Digitally altered") into a corner of every altered image.
- Keep the unaltered original of every photo and be ready to hand it over.
- Never alter structure: walls, windows, views, room size, fixtures that stay.
- Say it again in the listing text ("Some images are virtually staged").
- In the EU, the same image also needs its machine-readable mark intact (Article 50).

Checklist — AI video (ads, reels, shorts)
- Disclose synthetic content at upload (YouTube) or toggle the AI label (TikTok, Instagram).
- Realistic people, voices or events → visible label in the video or caption, not only metadata.
- Cloned or synthetic voices: disclose, and keep consent records for real voices.
- Keep the model's original export (Veo and Gemini Omni carry SynthID).
What is not required
Article 50 does not require labels on obviously artistic or fictional content that no reasonable person would mistake for real (an anime character, a stylized 3D scene), nor on minor assistive edits such as colour correction. When in doubt, label — a label costs nothing, an omission can cost a listing, an account or a fine.

What does the EU AI Act require for AI images and video?
Since August 2, 2026 the AI Act's transparency obligations (Article 50) apply: AI-generated or AI-manipulated images, audio and video must be marked in a machine-readable way and disclosed as artificially generated, and deepfake-style content — realistic depictions of people, places or events — must be visibly labeled even when nobody is meant to be deceived. Does this apply to me if I am outside the EU?
If your content reaches people in the EU — an Instagram account with EU followers, a listing site with EU visitors — the obligations follow the audience, not your address. Most creators simply apply the EU standard everywhere.
What is California AB 723?
A real-estate law in force since January 1, 2026: every digitally altered or virtually staged listing image must carry a conspicuous label such as "virtually staged" or "digitally altered", the unaltered original must be available on request, MLSs enforce the on-image label, and willful omission is a misdemeanor.
How do Instagram and TikTok label AI content?
Instagram has tested an account-level notice ("This profile posts content generated or modified with AI", May 2026) on top of per-post AI labels and reads C2PA credentials. TikTok automatically labels content made with its own AI tools and requires manual disclosure for third-party AI content. YouTube asks for disclosure of realistic synthetic content at upload.
